Consumer Law, Warranties Trusted contractor took deposit for materials, now not responding.

A contractor we have used a number of times over a few years (as have friends) was to do a $3k job for us. In April, we signed a work order and gave him $2000 to order the materials and expected the materials to be in and work to be started by late-May or mid-June. We saw him a few times since and was told everything was still on order.

Now we cannot get in touch with him, after over 3 weeks of phone calls that are not returned we believe he blew the money and is ignoring us.

We have a signed (by myself and the contractor) worked order (generic form without his company name) that lists the work to be completed, total cost, and what we paid him as well as a copy of the check he cashed. We do have his home address as well.

Is this a criminal matter in NC? What is our best course of action? Call attorney? Police?
