(trial de novo) should I request ( ex parte )?

Hello my question is this I already did a TBWD & was found guilty because I only put "not guilty" that's fine I got this bogus ticket because the CHP officer states that I cross over ( 2 sets of double yellow lines) in the middle of the divided Hwy. she is clearly wrong so I am doing a( trial de novo ) next friday
Oct.21,2016 Now it is the same judge who did my TBWD and I found out the traffic court for trials only has one department for traffic trials and it is the same judge who did my TBWD I heard it should not be
the same judge for my ( trial de novo ) am I correct in saying this. Or should I request (ex parte, per C.C.P. Section 170.6 that the said judge,commissioner, or referee be disqualified from hearing the entitled matter? true or not.
 
Apparently you're wrong - I poked around and found instances where it was the same judge.

Do you really think that the judge will remember your particular case out of the (probably) dozens or hundreds a week he decides?
