In june 2007 we got approved to buy a car. We've been paying every month after the due date but before the next payment's due date (which is the 26th of each month).Because of being late with the payments every month the financial company was calling us every month to set up a date for us to make the payment.Meanwhile we had a liitle accident with the car.The insurance company wrote a check on both ours and the financial company's name, which the financial company refused to endorse before they see the car fixed and before we make the monthly payment. We then took the car to a body shop and the insurance company wrote another check on the name of the shop.We got the car fixed but we were still running late with the payment which was due on October 26th. On november 23rd the financial company sent a towing vehicle to take our car. Now we had to re-apply for a credit which the leanholder says is a standart procedure.
My question is - were they right to take our car and not give us a chance to make the payment in the next days left before the next payment's due date? That was also the first time we were quite late with the payment but still not more than a month late. Also what rights do we have if they refuse to give us the car back?
Thank you
