Termite inspection with buying, selling house

We purchased a house in Gothenburg, NE in August of 2005. At the time of purchase a termite inspection was done. We were told termites were found in a wood stack next to the garage. This wood stack was removed and we were told it was sprayed for termites. We never saw an official bill for this work. We just sold the house, and a new termite inspection was done.
The inspector told us there are traces of termites in the house and the garage, and there is no sign of any treatment done ever. So we had to pay for the treatment in order to sell the house.
According to our current realtor the seller is obligated to pay for termite treatment. Which the sellers never did, so they did not honor our contract.
He advises us to seek legal advice, so we can make the previous owners pay for the treatment.
Do I have a case? What steps do we need to take?
