I have been served with a summons from the San Mateo Superior Court. I am being sued by a credit company under rule 3.740 collections. There is no court date listed that I can see on the summons. It states in the complaint that I have 30 days to file a written response. Here are my questions?
The debt owed is valid but 50% of the amount they are sueing for is for penalties and late fees aquired while I was on workers compensation and not working. I would like to go through the process of disputing the amount, which is $2,023.13 to see if I can get it lowered to the original amount of the debt before all the late fees and penaties. I went to the county info page to find out what form that I need to file my response on but could not find it. One, is it worth my time to fight to have the amount lowered and if so what is the name of form that I have to use to file my response to the court. Also, if I fight this and loose, can the plantiff sue me for court costs?
Thanks
