Curious as to whether it is legal to perform live sex shows in a clients home for $$. It would be a couple having sex while someone pays to watch, No contact between the client and either performer.

I'm not going to do the amount of research it would take to get you a verified answer but I will give you my best guess. Live sex shows would be lewd and lascivious behavior if performed in public. They would require a permit for that type of business. Now being that you are performing in someone's home, they have the expectation of privacy in their home so I imagine that a live show with no touching would be legal. You can not masturbate them, you can not touch them in any way, and I would assume that would mean fluids also.

I am going to put this caveat in here: There is the possibility that this would be commercial adult entertainment without a license even if performed in the privacy of someone's home.

Would love to have some more opinions on the subject as times are tough and i am looking at alternative and extreme measures to survive this economy.
 
You will likely have issues of zoning and licensing to contend with as well as any local ordinances or state laws restricting such operations. This also means additional costs for insurance, workers' comp, W-2s or 1099 documents, etc.

I doubt this will be as simple as just opening the front door and allowing people to come in and enjoy some voyeurism.

You might consider consulting a local attorney who can review the local and state restrictions on such a thing.

Wouldnt really operate as a business. More as a cash deal. And the guys wouldnt come to us we would go to their homes. Sort of like watching porn on the computer but we would be there in person.

I agree. What i meant was we wouldnt be operating like a "normal" business. More like a business on the down low.

Basically what i need to know is is it legal in the state of SC to perform live sex shows for individuals in the privacy of their own home?
 
Appreciate all the input. I am not concerned so much with the tax issues as the criminal record that may be associated with an arrest. Bottom line is, I have one opinion that says yea it may be legal but......

Was hoping for a more definitive answer as far as what the law states! This is not something i am especially proud of considering...but i have been out of work for 10 months, no unemployment as i was a sub contractor, and i have a family to feed. So is there anyone here that can tell me Yes it is legal or No it is not legal??
 
I do not believe for one mila second that you cannot find another means to bring income into your home! Contact a criminal defense Attorney he should have the law you seek and not worrying about tax issue isnt very bright either
 
I can work ay McDonalds 40 hours a week and make squat or do this 5 hours a week and make 4 times what i would make at McDs! I am a professional who's industry has died in this economy. Im afraid not everyone has the lawyers salaries y'all get! If i could afford to talk to a criminal defense attorney i would not be here seeking free legal advice.

As far as taxes go, my taxes would be paid on any income i receive so that is why i am not concerned
 
You need to research your state statutes and local ordinances regarding adult entertainment. You likely need to have a license to do this legitimately. The issue of money changing hands is significant, even though you would be in a private home. Doing something like this would not stay "on the down low" for long, so you better make sure you have your ducks in a row so police don't get involved.

The quotes above by cdwjava and jharris come as close as your going to get to the actual answers. No one here is likely going to invest the time to research this so you can find out if its ok to give private porn shows.

You have other options besides Mc Donald's! This is a choice your making not a necessity

Do i? How can you possibly know my situation? I am in a state with nearly the highest unemployment rate in the nation. There are no jobs here! My area of expertise has died and i truly need to do something to make ends meet! I appreciate your help, but you can not possibly understand how crappy things are where i live. I was hoping when i posted here that someone knowledgeable with the laws HERE would know the answer. Simple as that! As i stated i do appreciate the assistance that has been offered and totally understand someone not wanting to research the laws.....but on the off chance someone that read ths forum knew whether or not this is legal i figured i would post and ask.

YES this is a choice i am making i do not deny that......but it is a choice of necessity! I would much rather find a regular job in my field....unfortunately that is not an option!
 
Your situation is not uncommon among millions during these hard times. You "have" other options your just choosing to explore one that can potentially land you in jail and hurt furture employment in your chosen field. You seen dead set on doing this then go ahead. A quick call to an Attorney (no charge involved) or to Police (one has already replied to your thread can also get your answers. We dont sit here with law books on all subjects and all states sitting next to our computers
 
"Explore" being the key word!! I have not decided on doing this, in fact would prefer not to! But believe me I am growing weary of not being able to feed my kids and pay my mortgage. Tired of standing in line with 60 others for minimum wage jobs i know i have no chance of getting because i am over qualified. Tired of wondering how i am going to pay my bills and to a point where desperation becomes an acceptable alternative to losing everything!

Of course, what you are considering could involve jail time, the loss of your children, and the seizure of your property if the laws of your state allow for it - especially if revenues from an unlawful business are used to pay for the property.

On the other hand, McDonald's is LEGAL work, even if not the greatest job or career potential. ANY work is better than NO work. In fact, I just came from a class at our social services agency where they are learning how to get jobs and how to live better, and one of the subjects that came up was precisely this - getting a job that was either "beneath" you, or, a job that paid less than you wanted. These folks would be happy to get a job at McDonald's.

As one of my neighbors put it to his son-in-law who was explaining why he turned down a job ...

SIL: "Pop, it only paid nine dollars an hour."

POP: ... Long pause and a slow nod ... "And just how much are you making right now?"

Any lawful work is good work. If I had to feed my family I'd be taking any job that I could, not one that could get me tossed in jail, would expose my family to unseemly activity, and one that could potentially cost me everything I own.

I know times are hard, but there are options - you just have to plug away and consider all the LEGAL possibilities.
