My husband has already went to his pretrial and was given a sentence for 2 third degree misdeamenors, an additional two years probation and time served. He has already went up in front of his parole board and is waiting on a decision. He has not been released yet and is still incarcerated. My question is how long can they legally hold him without a decision? His lawyer was not sure but thinks it is 30 days from the date of the parole hearing and if the parole board has not reached a decision in that 30 days then they must release him. Just wondering if that is true?

I'm not 100% sure for the state of Ohio, but my ex had gotten into trouble recently as well. I was told by my personal attorney that they must let him out 30 days after arrest, if in fact the case wasn't pursued. This is in Florida.
