I won a judgement back in 2007 for breach of contract(non-compete clause). My lawyer paid for a service officer to service the defendent. The officer then could not identify who he served. The defendant got an appeal against my winning judgement due to improper service.
I ran out of money for a new trial and I was not able to acquire a new lawyer to take the case on a contingent basis.
Does the statute of limitations apply to my case?

I now have the money for the case again 7 years later.

Would this be considered an ongoing case?
 
The SOL has tolled.
It's 4 years in California for BOC.
Beyind that res judicata is in play, let the thing rest, the law has spoken.
You prevailed at trial, the defendant prevailed at appeal.
It's over.
