Hello, I have been divorced for two years. Part of divorce agreement was that marital home would be sold and proceeds would be divided according to divorce agreement. Partly due to his poor health, my ex-husband refinanced home twice and delayed sale of home. Now, due to slump in real estate market and his continued inability to work, the home is in foreclosure. I understood that he could not legally "squander" the marital asset, but this is just what has happened. Can I place a lien on the property to hopefully receive part of what is owed to me, per divorce decree? I believe the home is currently under negotiation for a short sale. If it is sold in a short sale, will the lien be honored? Please help. My own home is now in pre-foreclosure because of the actions of my ex-husband. I appreciate any advice as I do not have the funds to afford an attorney. Thank you.
