They live upstairs
Rental Agreement plainly states NO SMOKING
The people upstairs have started smoking inside the premesis. This is very apparent by the smell, and they make no attempt to hide it. At first we talked to them, and asked them nicely to not smoke inside the residence. THey said they would comply.... they did not. We then informed the landlord. The landlord talked to them, they said they would stop... they did not. We have verbally told the landlord again, he spoke with them again, they did not quit. This has now been going on for almost two months. We are non smokers, and are at wits end. We really do not wish to move as the location is perfect, but we will if we cannot get this resolved.
What options do we have.
Can we take legal action against the neighbors?
If we move out, what rights/requirements do we have as we feel our rights to clean healthy air are being violated (as stated in teh agreement, non smoking.)
Is there anyway we can help the landlord to get rid of the tennents?
Any advise is appreciated

If this helps, we have two young children, and are very concerned but do not have the finance to move at the moment, we are quite stuck in this situation.
