I was served with process today for an eviction suit set for next Thursday... I wanted to file a counterclaim but when I called the JP's office they told me I couldn't because I couldn't evict the landlord... that's not what I wanted to do, but she said the only thing I could do was file a SCC claim against them... which by now would obviously be heard after the eviction suit which is not good.

So the question is, would it be best to request a jury trial instead of just letting the JP decide? I need to decide with in 5 days and I'm not sure which would be best. Any thoughts???
