If the Sex Offender Registry Board is granting relief to offenders who were not notified of their duty to register in the qualifying case, would they be required to always grant relief if the circumstances were the same?

The hearings are closed to the public, does this mean that there is no case law references?

Think of it this way.

Fred murdered Joe. Got sentenced to LWOP for that one.

But when BillyBob murdered Simon, he got sentenced to death.
 
I guess what I'm asking is if the relief is based on the failure to notify, or the timing of the enactment, and the circumstances where the same for both registrants, could the difference in rulings be illegal?

It doesn't seem right to me if it is being applied unconstitutionally to one person with certain circumstances, then it should apply to everyone else with the same circumstance, right?
