Seller applied for duplicate title after selling me a vehicle and had the car towed

Hi,

I was buying a car and agreed with the seller (extended family) to register the car on Friday. Today he apparently took out a duplicate title earlier and used that to have the car repossessed and held in a lot until I register it. The towing company said they would go down to the tag office with me so I can register the car, I then have to pay the towing company $320 for total cost of towing and storage. The towing company says they have a tracking number for the duplicate in the mail but haven't received it yet. This doesn't seem right, I have the original bill of sale and original title signed by him. Do I have any options? The DMV was no help.

Why didn't you register the car on Friday?
Why don't you simply get your money back from the relative and let your relative deal with the cost of the tow that he requested?

I can tell you must be one of those people...Friday is 4 days from now.

How long have you had the car and the title without titling and registering it in your own name?

And why didn't you title and register it as soon as you got it?

Did you pay him in full when you got the car?

Did you ask him why he did what he did? What did he say?
 
Usually when a car is purchased you will receive the title and have several days to register with the state.
The seller usually has to compete a release of liability which notifies the state they no longer have interest in the car since it is sold.

When did you buy the vehicle? Are you still within the days to register permitted by your state?

Did the seller compete a release of liability as required?

I suspect you will have to pay the grow fees to get the car, but you may be able to turn around and sue the relative in small claims to recover your expense. Once they sold you the car they had no business authorizing a tow.

I bought the car in New York and was taking it down to Florida to get it registered down here. I'm here now and I talked to him and told him I was going to register it on Friday and will mail the plates back up. I bought the car due to an issue stemming from work. I no longer work with him now and so this was just a way to retaliate and inconvenience me, which it has.

No release of liability on his end. I personally understand him being able to take the plates back but reposessing the whole car and making me pay towing fees is ridiculous. The towing company located in Apopka, FL required me to turn my keys over to them or they would not give me my personal belongings back out of the car.
 
Sue the bad guy for the return of what you paid for the car for the improper repossession. Let the bad guy deal with the tow costs for his vehicle.

You will need to sue him where he lives.
