Here is the VA Security Deposit statute:
§ 55-248.15:1. Security deposits
However, if the LL ones only the one dwelling (or two) in his own name, he is exempt from the landlord tenant statute. See 55-248.5 A 10:
§ 55-248.5. Exemptions; exception to exemption; application of chapter to certain occupants
If the LL is exempt under that section, you will need some other legal theory, like breach of contract depending on what your lease or rental agreement says about the security deposit.
