Here's the situation: I would like to sell a hat that is very similar (unsure if identical) to one that was popularized by a TV show. This hat was produced by another company unaffiliated with the company that produced the TV show. The hat bears no trademarks whatsoever.
As the hat is rather mundane in appearance, for me to sell it profitably, I will need to reference the TV show that is associated with this hat's style in my ad. What are the legal ramifications here? Is this permissible? Is there certain wording that I can and cannot use?
