Back in August my roommate and I transferred to another apartment with a friend and signed on to their lease which is now on a month to month basis.
I knew I would be moving out at some point and asked my landlord for the paperwork to remove me from the lease, they told me when I knew the exact date to come and sign the paper and everything would be fine.
A few months later our friend moved out and we signed him and his cosignor off the lease. Our landlord requires all tenants that don't qualify themselves to have a cosignor, but somehow my roommate got away with not having one. After our friend and his cosignor were off the lease, this left my mom as the only cosignor for the apartment.
Our landlord was after my roommate to get a cosignor on the account, even threatening eviction if she didn't get the paperwork in.
Meanwhile, I had been looking for another place to live as the place I had planned on fell through and finally knew I'd be moving out in November. I picked up the form from my landlord and my roommate, my cosignor, and myself all signed on the 19th of November. The next day my roommate went to my landlord to tell them she'd be vacating in 2 months.
Shortly after I received a phone call from my landlord telling me they couldn't remove my cosignor and me from the lease because my roommate doesn't have a cosignor and won't qualify for the apartment on her own.
Now they're (my roommate and landlord) holding me responsible for rent and the apartment even though I filled out the paperwork, along with having my roommate sign a form that says she takes full responsibility.
On top of everything, I discovered she had a puppy in the apartment (which your not allowed to have) and am going to end up being responsible for the damage it does to the apartment.
Is there any way she can legally be forced to have a cosignor by my cosignor, as they're pretty much guaranteeing my AND her rent at this point? Or is there anything I can do to get myself off of the lease? Both my landlord and roommate knew I'd be moving out since August, all the paperwork was signed, and now they're not releasing me because she doesn't have a cosignor, something they were going to evict her for in the first place.
I can't afford to be paying rent at an apartment I'm not living at on top of the one I just moved into, but I don't want creditors and eviction notices going against my cosignor and I.
Please help!
