Requesting police report

My brother passed away last July 2012 & we have been trying to get a copy of the police report. We sent in the proper form along with a copy of a letter requesting the information. We received a letter back denying our request due to: "Your request for Police report XXXXX is a NonCriminal Investigative Record and is therefore exempt from the Open Records law, Section 708(b)(17). To obtain a copy of this report a subpoena should be obtained through the courts". Can someone let me know why this would have been denied & the process needed to follow in order to get a copy? Thank you.
 
First off, you didn't furnish the name of the state involved.

It seems because it is a non criminal investigative report/record, it is exempt from the Open Records Law & needs to be obtained by subpoena through the court system.

Why do you need the report - for insurance purposes, a lawsuit or some other reason?
