My daughter just recently got devorced and he got the truck & she got the car, the payments are $400 a month on the car and she trys to make those payments on a $10 an hour job. With all the others bills she called the bank and she told them that she can't make the payments.
They told her that they will sell the car at a pulic auction and she owes $17,000 and if it sells for less than that she has to make payments on the difference.
Can they do this in forcing her to make payments?
She wants to get on her feet but looks like her hands are tied by the Bank.

Yes if the bank repoes it and it does not sell for what she owes (no cars ever do since most people are upside down) then yes they can go after her for the difference. she should get a second job or find a way to make the payments otherwise her credit will be ruined and they will get a judgement against her. She might want to see a BK attorney.
