removal/eviction of non rent paying (ever) family member:
we allowed our daughter to stay with us for awhile after her divorce, now she wont leave. What are our rights, what can we do to have her removed? Does she require eviction? Why? Can I just call the police and have her removed for trespassing? She need to be removed immediately!

You can always change the locks when she's away. Otherwise, call the police and ask them.

You might have to go through the normal eviction process for your state/county. You can do a google search on how to do this in your area.

Generally, in your state specifically, when you allow a deadbeat to live in your home the ONLY legal remedy is to evict them.

That means you can't arbitrarily change the locks, drag them by the hair tossing them out, pitching their junk into the street. It means a legal, court ordered EVICTION.

That requires to give them WRITTEN 30 or 60 day notice before you can even file an eviction. Then you file after the 30 or 60 day period has elapsed, waiting another 60 to 90 days for a judge to give them an additional 72 hours to leave. If they don't, a few days later the sheriff will evict them.

Yeah, it sucks. But, it's the law in your state. Google "YOUR COUNTY CA EVICTION" and you'll see EXACTLY what you must do in your county.

Some people offer deadbeats $500, $1,000 to leave. They get them to sign agreements to leave giving them the money only after they've left. Then, don't ever allow anyone to live in your home again! Send them to hotels, give them money for hotel stays (if you want) don't let them abuse you or your home!!!
