Refusal to sign the mortgage documents

Hi all,
In need of some desperate advice, my partner and his ex bought a house together over three years ago of with his ex partner who has contributed nothing at all and the relationship ended after 9months of living together.

We have now been trying for past two years to remove her name from the mortgage, costing nearly £3,000 already. The last step was back in may, after attending court she signed the legal documents stating that she was happy with the offer and would sign the mortagage over.

However, the courts gave her 8 weeks to do this and she has refused, yet again, to sign the actual mortgage document. Where do we go from here? Do we yet again have to pay to take her back to court? We simply do not have the money.

To make matters worse, due to recent credit crunch we are struggling to pay the mortgage each month. We have never defaulted and were considering asking for a mortage holiday. Although, after recieving the application form it seems that we have to have her signiture as well, which will be refused.

Any advice would be fantastic, we're lost and are worried about losing the house.

check the court documents. i would think that there should be something noted from the hearing that she agreed to sign and that the court agreed to it and gave her 8 weeks. not signing should put her in contempt. contact the circuit clerk at the court you went to and/or a lawyer and find out how to go about it.
