Trying to find some straight answers before spending $ to start refi process.
We live in Western New York and that is were property in question is as well.
My wife, my father and myself are all on deed for house. I am the only one on the current mortgage.
My wife has several judgements from Credit card companies against her. Obviously these are public records. I am looking to refi the house in my name only. Will these judgments disrupt the refi process considering her name will not be involved? I have read that unsecured debt can not be attached to real property but I have also read to the contrary. My credit is clean and I am positive I have no judgements or outstanding loans.
I will be going to the county building tomorrow to find out what I can, but anyone with any knowledge in this area would be greatly appreciated. Thanks.
