brother was arrested on a delivery of a controlled substance charge or conspiricy of later dropped to an intent to sell a controlled substance. nothing was ever found on him when he was arrested however they got a recorded phone conversation of a female who was working with the sherrif and him discussing prices is this enough to convict him or should he fight it. he has a long criminal history and the court appointed attorney says the state wants a drug conviction and for him to do a prison set. he has 30 prior drug convictions can they base it off his past. dont know wether to take the deal of 18 months or fight this they have nothing other than a phone conversation. help please
