I am an alien who studied in the states for PhD, and then worked for an year.
Last April, I made a big mistake, and was arrested for theft.
I was charged as misdemeanor, and recently my case was resulted in 'will be dropped if I submit DNA sample and take a class'. I'm currently out of the state because my previous visa was expired, and am waiting for H1B visa processing from Washington state univ.
My question is, what are the chances that my H1B will be denied because of this issue? and what kind of documents do I need prepare for the visa interview in relation to this matter?
I deeply appreciate your time, and will look forward to hear from you.
Thank you again.

If I were you, I'd avoid returning to the USA.
The economy is in the toilet.

If you still persist, speak with someone at the nearest US Consulate or US Embassy. One of the many bureaucrats in residence should be able to offer you more precise and specific information.

Wow, a PhD and he still thinks America being called the land of opportunity meant everything not nailed down. The fact is Ineedachance, you had a chance. You screwed the pooch. You can of course attempt to find a company that will hire a thief, however, they can easily obtain one already possessing status.
