Hello. I was caught in a bp sting. I showed up in a very long dress. I made it clear that all donations are for my time. Decoy said something sexual first then i stupidly back. Busted!
They are using my ad against me which depicts me in sexy photos, but it doesnt refer to any sexual acts aside from maybe kissing.
I was busted a few years ago, but they couldnt prove a case. The decoy got bare naked! I only gave a massage but i said something sexual. Back then i thought decoys couldnt get naked.
I have to prove to a judge that my intent was to be a prostitute.

My lawyer said a judge my ask,"What do you usually do with men?" I always allow the man to set the pace. I dont sell any activity just my time.

Im scared and never had a real trial. Can anyone help me with my mens rea issue?

Im tired of police abuses, and im willing to appeal if they try to send me to jail.

Police abuses? Really? You're a prostitute. Now not judging. Don't care. It should be legalized and regulated but - it's illegal to be a prostitute.

You have a lawyer. Do what your lawyer says to do. Don't talk about this to anyone else. No one knows what the judge will do or what you have to look forward to.

Leslie82 ad adjusterjack, this forum has the brightest and dimmest posters.

You both are two of the brightest.

Yeah, right.

You have sex with men for money. That's the whole idea no matter how you spin it. You know it, the men know it, the cops know it.

You got caught.

If you don't like the consequences, stop doing it and get a job where what you say is not incriminating, like: "You want fries with that"? :p
I did have a job, and it paid $1000...a month. Many women get around this by having sex for money ie sugar baby, fwb, etc. Theres not a lot of economic opportunity where i live.

Actually, a lot of escorts get paid big money to talk, go out on the town, etc. What each woman does varies. Trust me, i wouldnt mind getting paid $$$$ to cuddle which sctually i do a lot of. I do a lot of talking, cuddling, ive had men fall in love with me. Some girls get proposed to. Some of these guys, are my friends. Please stop talking like you know whats going on. Being an escort is about companionship. Stop basing what i do on what you see on tv.

I am an escort but also a woman. I have been sexually assaulted by cops, and i know other women who have been. If you dont believe an escort ( i dont sell activities only my time) can be assaulted, then you are part of the problem.

I actually do a lot of talking and cuddling. Being an escort isnt quite what people think it is. I sell companionship, not sex. Its barely any different from meeting guys on pof aside from the label.

Im tired of this and hearing about abuses. I think the real problem is that outdated statute. Thats why im willing to appeal. There was a case not long ago. Women are starting to fight back.

As a licensed attorney, who is licensed in several states, and by the federal courts; you have several problems.

Stop talking.
There's a reason for any criminal defendant to remain silent.
You aren't required to defend yourself.
Why?
The constitution grants you that right, because the state must prove any and all allegations to convict you.
That is an extremely difficult task, unless the criminal defendant starts blabbing, explaining, lobbying, alibiing, pontificating, and campaigning.

Its best to remain silent, allow your lawyer to tear apart the prosecution's case in court or at trial.

Yes, those are two very different times.

Let the state present their case, as that's being done, you build your defense.

Too many criminal defendants start defending before the prosecution lays out their case.

Whether one endorses any activity or endeavor, if it has been declared illegal, it remains illegal until the statute has been overturned or repealed.

You aren't skillful in defending yourself, enthusiastic YES, skillful NOT.

Defendants say too much, repeat it too many times, and assist the state in finding that defendant guilty.

Most of what is uttered, by the way, is unnecessary, irrelevant, and meaningless; except to aid in tightening a noose about her/his neck.

LA law on prostitution:
..
..
2011 Louisiana Laws :: Revised Statutes :: TITLE 14 — Criminal law :: RS 14:82 — Prostitution; definition; penalties; enhancement
...
...
A. Prostitution is:

(1) The practice by a person of indiscriminate sexual intercourse with others for compensation.

(2) The solicitation by one person of another with the intent to engage in indiscriminate sexual intercourse with the latter for compensation.
...
...
Your problem is defending against solicitation, not practice.
...
The law defines solicitation as:
...
...
A person commits solicitation when, with intent that another person engage in conduct constituting a breach of any law or ordinance, he/she solicits, requests, commands, importunes, or otherwise attempts to cause the other person to engage in such conduct.
...
...
Simply put, if you discussed sex acts negotiating a price for sex acts, describing those sex acts, clarifying those sex acts, or illustrated/demonstrated any pay for play scheme, you've violated the law.
...
Plus, EVERYTHING you did or said (maybe both) was more than likely recorded on audio or video.
That, my friend, is your problem.
Now, more than that, you've also admitted here on this forum.
Does that make it any clearer for you, mate?

Thats pretty much what the lawyer said.

Lawyer at first meeting said its kinda of murky as to why i was there. I am on tape agreeing to spend time with the guy for a certain amount.

Im not good at defense- which is why i got a lawyer! I am quite impassioned. Im tired of lazy and abusive cops. Im ready to challenge the statute all the way to the supreme court if need be!

Im mostly scared of saying something wrong on the stand.

If you have an attorney you shouldn't be posting stuff on an internet forum.

Keep your mouth shut and follow your attorney's advice.

Sorry I have never had sex for money. I am a woman. Never have I been desperate enough to have sex for money.

Those women either don't get caught or if they do, they go to jail. Or get a deal.

The bottomline is you got caught prostituting yourself which is still illegal. I have no issue with prostitutes. As I said I think it should be legalized. Then it can be regulated. It would decrease sex trafficking somewhat. It would be safer for the workers (female or male). They would have to all get tested - workers and clients. Risk of STIs goes down some.

Oh yes that's exactly what men get prostitutes for "companionship." No they get a prostitute because they're freaky old men or they can't get a woman on their own. Some girls get proposed to? LOL you are the one who needs to stop watching TV. I very highly doubt Pretty Woman scenarios are going on in the prostitution arena.

If you want to sell yourself, move outside Las Vegas to the one area it's legal. Then you don't have to worry about going to court and being arrested.

Say what you want, but i have made a better life for myself and my family. I came here to talk to people who are experienced with trial not for judgment.

No one fucking judged you - it was said if you don't want to get arrested for prostitution then don't prostitute.

So listen to your lawyer and this lawyer and stfu.

How are the cops "lazy and abusive" when they did their job?!?!?

Do you realize how many teenagers and minors are being prostituted through sex trafficking right now in the US? THAT is why the police do these stings. To stop the damn sex trafficking rings. But if you have no issue with minors being prostituted then that's your issue.

Good luck challenging prostitution up to the SCOTUS.

Fancy that, huh?
Your lawyer is TRYING to help you.
You're, excuse the phrase, SCREWING yourself for FREE.

If youve never been this desperate, then consider yourself lucky...Btw its the experience not the sex esp the higher up you go.
Im living this life and you dont. If you think its just freaky old men, then you are really off base. If you think the onky reason a man will visit an escort is because he cant get one, you are very far off base. Bottom line is i know more about it than you do. I live it and, i know other girls who do. Its actually not much different from dating. Yes, people fall in love, get proposed to, or occasionally get married. We are people, too.

In those brothels, you are basically a slave.

At least we can agree our current laws need to go!

You do realize cops spend most of their time policing consenting adults. They are arresting tge very people who would kniw if something strange was happening.

Most trafficking is for labor not sex, by far. Most people even 16 17 year olds are on bp voluntarily. Its very difficult to force an anle bodied woman to have sex against her will. It does happen, but someone would almost have to be an idiot to even try. Everyone has a phone, the moment he leaves her alone shes gone. A case happened not far away where a guy was trying to forced doped up strippers to work. When he left, one of them ran away. In order to traffick someone, you gave to have them on lockdown 24/7.

If they are indeed trying to find victims then they should concentrate in finding them. How is having sex with or fondling a sex worker helping cops find victims? Thats what theyre doing with youre taxpayer dollars! The sex trafgicking thing is propaganda they use to keep themselves relevent. Im not saying it doesnt happen.

A cop could easily do busts as they do now, ask girls if they are being trafficked. If they say they dont need help, leave them alone and find real victims. If they did this, they may go through hundreds or thousands of girls to find a handful of victims but they wont have a bunch of arrests.

I 100% believe cops should find real victims. In my experience knowing people whove had a car stolen or burglarized, cops usually do the bare minimum. Hell, some pds have been sued for not testing 15year old rape kits. However, engage in a victimless crime and cops pull out all the stops.

What many cops want is easy arrests. They want people who will go on the stand and plead guilty.

Im willing to challenge the law if need be, funding is my problem. Theres already a lawsuit i believe in california.

Since you have a lawyer, work with your lawyer - that's the bottom line.
