My husband was awarded his house in his divorce settlement from his previous marriage. It states that his ex was to remove her name after he refinanced the home. However, he was unable to refinance the home due to being upside-down on the home value. He did however find out that she could have still removed her name frome the property through the bank that the home loan is through but she refused to do it. Now he is short selling the home and he has already had one offer fall through because she will not send the information the bank is requesting to finish the short sell and has another offer on the house. She has signed the offer agreement for the house but is still not providing the paperwork needed to complete the short sell. Is there anything that he can do to get her to cooperate without him having to foreclose the house?
