A neighbor has done over $2,800.00 damage to our barn. Over a 8 month period, using a high velocity sling shot and marbles, he shot out the window and put holes in the new vinyl siding. During this time we were fearful to use our backyard,fearing we would be struck by a marble. We spent considerable time trying to identify the culprit. Then we spent more time and considerable money setting up closed circuit cameras and a recorder to obtain videos of him doing the damage. The police say they can charge him with a felony for Malicious Destruction of Property. They indicate since this is his first offence most likely he will not receive any jail time but would be probably be ordered to pay for the repairs.
The neighbor has offered to write us a check for the repairs, if we do not press charges.
Question: If we accept the check for the repairs, can we seek punitive damages for our time and loss of use of our property?
