Problems with tax

The seller put on an addition in 2001 and closed all of his permits in 2005. The taxes on the contract for sale are $5,900.00, the township is going to reassess the property because the permits were not closed in a timely manner, that will bring the new taxes to $10,000.00, The seller did not disclose the permits were open for that length of time, all the sellers disclosure said was that the addition was put on in 2001 and all of the permits passed. Is this actionable?
 
Is there some reason the property could not have been reassessed for tax purposes if the permits had been closed at an earlier date?
