Do I have a case if I have proof a private dealer had prior knowledge of needed repairs for the vehicle he sold me? Proof showing inconsistent, misleading, false information in order to make that sale? Proof of private dealer contacting me and telling me he was going to refund me the full amount, agreeing to picking up the car and title from me. And contacting me two days later changing HIS agreement he made to me NOW saying for me to bring the car to the shop across the city "because since I'm giving you the whole refund it's only fair." Although he is aware the reason for my refund is because one of the reasons is the car he sold me cuts off when shifted into drive

If he's willing to refund you on an "as-is" sale and all you have to do is drive across town...take the deal and consider yourself lucky.
