My husband and I recently bought a 30 year old home and the seller failed to disclose a 29 year history of foundation problems to us. In fact there was no disclosure included with the deed even though it is required by law in our state. Do I have any recourse on this matter?

Does your contract for sale address disclosures?

If it does, what EXACTLY does it say?

Didnt you get an appraisal or home inspection done? Time to see a real estate attorney but if you did not due any research or inspection on the property, part of the fault lies with you. You also have to prove the previous owner knew about the defects.

Consult local counsel.

No, disclosure was not mentioned, and we do not have a contract for sale. We have a Real Estate Lien Note and a Recorded Deed of Trust. It is owner financed with a very large down payment. Since we did not get a disclosure has a law been broken?

How did you discover the foundations problems? What state are you posting from?

We found out about the foundation problems when the walls shifted and cracked and we got water into the sunken living room. The story goes on from there. We are in Texas.
