previous lawsuit for fraud

Hello,
I am involved in an lawsuit with my previous accountant. It is for fraud, malpractice, negligence. I am the Plaintiff, he the Defendant. I found out today that just 3 years ago he was sued for fraud and ended up settling out of court. Can I reference that in my objection to his motion for a summary judgment? Would I first have to send him a copy for discovery?

You can refer to it, possibly.

I would suspect it wouldn't be without objection by his defense counsel.

The problem you will have to overcome is relevance.

In other words, how and why does it impact YOUR case.

The HOW TO DO IT is defferent in every jurisdiction.
