Alcohol & Drugs: MIP, MIC, Intoxication Possession of marijuana?! Please help.

My fiance' was receiving a ride from a friend, & the friend was pulled over for not signaling a turn. The police searched the car and found, to my understanding, a tiny crumb of marijuana in the console of the vehicle. The driver explained to the arresting officer that my fiance' had no knowledge of the marijuana (which he didn't) and had only been receiving a ride. The officer still arrested my fiance' and did not put the driver's claim anywhere in the police report. I see this as being very unjust. Even if he arrested him because of possible "constructive possession", that possibility should have been squashed when the driver took responsibility. My fiance' has been incarcerated since June 1st. He has had run-ins with the law prior to this situation, but has changed his life. I need to get him out immediately. Everything is coming undone.I don't know what to do. I really can't afford his bail or to hire a lawyer. Any advice you may have will be greatly appreciated.

Well a peace of MJ that small would result at most in a misdemeanor perhaps a small fine usably nothing more and furthermore its strange that a cop would even arrest some one over something so small, At least its unusual where i live you need at lest a ounce to be arrested here normally. Since his friend did admits guilt he can be called as a witness to his trial and the charges should be a quited. the disappointing part is that he will likely have to wait till trial.
