My husband and I have been together for 8 years and married 6, he has been the only father my 10 year old son has ever known. They both want nothing more than for my husband to adopt him.
Here is the thing. His bio father has never had anything to do with him, the last time he saw him was 9 years ago. He has never paid a penny for anything, no child support, nothing.
His bio father is also currently in prison for 5 years.
Do I need to get his permission for this adoption? Is there a way to file for abandonment? I'm not sure where to go but I do know that his bio father would never sign his rights away just to spite me.

As long as the bio-father wont cooperate, adoption might not be approved.

The ONLY way to know is talk to three or four family law lawyers in your area.

The initial meeting is normally offered at no charge.

Be prepared to ask questions about the adoption process, time required if you're successful, the costs, and the invasive investigation your family will have to agree to endure.
