A 23 yr. old woman had sex in my home with a 23 yr. old male. They were both guests of my 23 yr. old son home for holidays. I was home and awake. The male escorted her out when her ride came to take her home and nothing seemed wrong except she had drank too much but she was drunk when she got here(I talked with her).The next evening the police come with a search warrant for my home.It stated that they search the residence and also the persons of the three men that were here during the evening. Which consitute evidence of the offense of: aggravated criminal sexual assault,criminal sexual assault and interfering with emergency communications.After going through the area of house and trash(looking for condum(found) and tampon(found).They asked my son to call the one other man involved(which I thought odd since there werre six poloice officers here that should have done the calling of the other suspect.)My son left with them as they told him they needed to swab his mouth(dna) I assume. The one man has admitted to consensual sex He gave the swab then was read his rights before they questioned him. The whole incident is a story from a woman on Prozac that drank too much.My question is what rights do I have as to finding out what the status of this investigation. My son says he wasn't arrested and he has left the county to go back to school.Can I call the deputy sherriff who subscribed and swore to the complaint?

None. It's an investigation, you can't get close to it. When charges are filed, you can get all the information through discovery. (Or the lawyer, these boys best not try to defend themselves). But you have no right to know how the investigation is going. Charges would be filed(which sounds like they have been) after the investigation is concluded. They will probably continue investigating in some form until the charges are settled.

Sure you can call the deputy, but it won't do anyone anygood. You might add something to the investigation. I would strongly advise you not to talk to the deputy.

There is something missing here. How did the police find out? Did this girl sign a criminal complaint, or some statement?

I'm guessing that because she was on drugs, then drank, she lost the "ability" to consent to sex. Is this correct?
 
Thank you for your response. After talking with the parents of the boy who did have sex with the woman, they were told by the states atty. that no warrants for arrests had been filed.So I wiil be patient(not one of my virtues). Again thank you for your advice.
