I received a citation for the destruction and removal of plant life within a state park. The boundaries for the state park were not posted and no fence had been erected. I had no idea it was a park. I was there to harvest palmetto berries for pharmaceutical purposes. Upon my first plea appearance I was informed that the charge had been changed to the destruction of public property and in addition another charge of petit theft had been added to the case. Is the state able to change the charge and add additional charges? Also, should I have been informed of my rights at some time during the process?
