oregon family court corruption, whats void mean?

I am a 29yr old Mother of four Wonderful Children, my children are my
life, my heart and soul, my everything. My two oldest Daughters are
from a previous relationship of five years and I also have two children
with my husdband, a boy and a girl. Does anyone know what it feels like
for a mother to have turned to the state for help against the abusive
father of your two oldest daughters but instead it ended up being the
biggest mistake of your life because instead of recieving the help that
you had been seeking your daughters are ripped away from you and given
to the man that had been both physically and mentally abusive, the man
that only wants to be able to control and hurt you and has now been
given the power to emotionally destroy you. I use to be a strong
believer in that ole saying, The truth shall set you free and as long
as you tell the truth you have nothing to worry about,never did I think
that it would be possible for someone to be able to get to the Judge
and fill there head full of nothing but lies and no matter what you
did, how hard you tried or what evidence you had, the Judges mind had
already been made. Denied of all rights.

I have a Question.... at the second hearing we had been assigned a
diffrent Judge and that Judge said that this order is all void, Judge
Kurshner cant do this its against the law, this whole order is void,
but then Judge Kurshner called us back into her court room and just the
otherday I was going through all of my court orders, docs ect... and I
noticed that my attorney and my ex's attorney had signed all of the
forms, orders, judgments but Judge Kurshner did not sign any of them,
does this mean anything cause I thought that Judges always had to sign
off on something that they had ordered to make it valid....

Did you take the kids out of state?

Do you have an attorney? Have you contacted a domestic violence group to help you with legal help?

No, I did not take my kids out of the state and No I do not have an
attorney at this point because I cant afford it also the last time that I
checked the state of Oregon has no funding, Legal Aid had been only
dealing with housing matters and yes my situation is long and very
complicated but what I said is true, I have never done anything in my life
to deserve to have my daughters taken away from me, I have done nothing
but love and protect them while their father was in and out of their
lives when ever it was convenient for him. March 04, filed restraining
order, March 13, (thursday) got notice in the mail that the restraining
order was being contested and hearing was set for March 17, (monday),
went to court asked to rescheduled because he had an attorney and it is
my right to have the same kind of representation as he does, The Judge
set the new court date for March 20, (thursday) I met my attorney for
the first time about 15min prior to the court hearing. I wondered
how and why the Judge hated me before I even got the chance to speak
well on March 25, I was served with papers because on March 17, he had
filed a Custody Petitution that I had no clue about, 14th Amendment to
the Constitution, Due Process Of Law, well it is kinda hard to defend
myself when I did not know that I had to. I have the transcript and it
speaks for its self. How is a Judge going to give someone custody when he
admited on the stand to beating me up while pregnant with our second
daughter and the police being called, a man who has felonys and a man
whome cant keep his storys straight but the Judge hates you so much that
she cant see past the hate to even give you the chance to defend
yourself and one more thing why would'nt the Judge order that a family
evaluation be conducted. It also states that paternity must be established
before custody could be determined and it was NOT.... all I know is that
someone is going to listen to me sooner or later and help me turn
the Injust into Just because I wont give up nor will I rest intill My
Daughters are Home with Me where they Both Belong....

You are not alone I am dealing with Judge Kurshner. I feel the same pain! I'm a mom and I feel she did not hear me. I thought she hated me too... I thought I was the only one but reading your post I know how you feel. GOOD LUCK!

YOu need to get this judge off of your case. I don't know how, but you need to get that done.

This is what the legal system is. There is no truth in a court of law, and if you're looking for justice, stay out of court. The whole damn thing is about money, nothing more.

They lawyers bleed you dry, screw everything up. The judges, what a joke, lawyers acting as judges, don't uphold their oaths of office. It's all a big scam.

Sorry that I cannot help you. I'm a single dad, and beleive me, I know what it's like when someone is screwing with your child in "his best interest".

Very seldom on a court of "law" will the best interest of the child ever be met. Welcome to Amerika.
