Sex Crimes, Sex Offenders old sexual assault charges

my fiance' and 4 other boys were charged with assault and battery with the attempt to sexual assault in 2001 court was in 2003 he did not show up for court but all charges were dropped by the girl and her mother. but now after 2 years they issued a bench warrant and he is in jail waiting for court. now let me tell you this he was locked up in 2004 and they did not issue that warrant then he testified for the solicitors office in march 2005 and no bench warrant was brought up then or issued then but why now. I do not feel like something is right and i do not want to do
