non working ac

Since our home was built in 2004, we have had problems with our a/c after moving in for a little over one month. When turned on, only hot air is coming out.. We called the builder and he came by, set up the system, and told us we had to turn it on from early morning to keep the house cool throughout the day. We tried that but it didn't work. The builder sent his guy to add freon... and it worked fine but we only used it for about one month since it took so long for someone to actually get out to us. The following year, we had the same problem again, freon added again... but the builder still denies that there is anything wrong with the a/c. This problem continues, last summer the builder sent his guy out, claims he put some kind of ink to test if there is a leak, but that was never done. I was there the whole time when the a/c guy said he did that. It's summer again, and our a/c is blowing hot air again. What steps would i need to take to get this taken care of.

A: Hire a qualified HVAC person to see what is wrong with the thing.

Alright, once I do that should I be liable for the labor since this was a problem from the very beginning probably poor work done by contracted HVAC?
