We are a wedding professional company that requires a Non-Refundable deposit in order to reserve a wedding date for our services. Our contract states, ... "A non-refundable deposit of $***.** is required to reserve the date. By submitting a deposit it is assumed that you understand the terms of this agreement. We accept cash, check or Visa/MC Credit Cards..." We received a call from the bride asking if we would hold the date, as her parents were sending a check in the mail. As a courtesy, we held the date for one week. After one week went by, we called, and the bride said her parents were definately sending the check. After two weeks passed, they submitted a check for the amount required. Our company deposited the check upon receipt. We then received a call a day after depositing the check that they had put a stop payment on the check as the wedding had been postponed, because the bride was having misgivings about the marriage. The Stop Payment went through.
My first question is, "Is this legal?"
Secondly, "Is there any recourse?"
