My husband was required to sign a non-compete as employee for corporation Y, saying that for his salary he would agree not to compete for 2 years within a 25 mile radius from any of corporation Y's locations. However, he has since been terminated, and all of his W2's and unemployement paperwork shows that he was actually employed by corporation X. Upon doing research, the two corporations have the same owners, but different federal tax id #s. There is also, no DBA for corporation X saying that they were doing business as corporation Y. Is the non-compete for corporation Y enforceable if he was never actually an employee of corporation Y?
