Hey all, I have been scouring the web for a bit looking for an answer to this question. I reside in a state other than NJ, I have my vehicle properly registered and inspected in said state. I visit NJ frequently as I have family still in the state, they are planning to leave the day they retire. I have friends in NJ as well who have recently informed me of roadside emissions check points set up targeting diesel powered vehicles. From my research it appears the legal code section pertaining to this is NJ 39:8-64.
A little backstory, many years ago I purchased a used pickup truck to pull my trailers; it happened to be a full size diesel pickup. The previous owner modified the truck after numerous issues with the onboard emissions the dealer themselves couldn't resolve. The system this particular year truck was outfitted with is problem prone, expensive to repair, and triggers a mandated shutdown no matter where you are a short time after a fault; inconvenient to say the least. Modifying the system was very common practice several years back. The newer models use a different system and are far more reliable.
Recently, NJ has begun roadside enforcement; I know I won't pass if inspected. From what I can tell the traffic code I posted grants them authority to do so. My question, being registered out of state as a private vehicle am I subject to NJ inspection while traveling thru? If so, what are the penalties?
I'm in a financial predicament with repairing the truck to factory state otherwise I would; I'm looking at putting $12k into a 11 year old truck with 300k miles on it. My home state also doesn't enforce this in any capacity, I even pass state inspection annually!
