Assault & Battery Need Some Advice. Please Help

Hello,

My name is dustin wesley and I live in northern minnesota. Heres my story, and if you can help me or lead me in the direction of some advice, please do so.

I know this kid named Ryan, I have met him maybe 3 times in my life, and hes freinds with kids I used to be friends with like 3 years ago in high school. Now I moved away for school and came back to minnesota 9 months ago.

Now this ryan, we never got along so there was always some 'beef' between us. Now he had gone around on www.myspace.com making a fake profile about me and saying some stuff for no apparnt reason, so me being me, i retaliated and did the same and said hes just some local loser with a GED.

So the past 4 nights hes came to my house with all his 'skater/punk' friends trying to fight me, now I figured, well its 2am and Im not with any of my friends, so the best thing would be to tell him to 'f off' and hopefully he will stop right? I mean these kids, this is what they do for fun, and this isnt my style, they hate me cause Im a jock and there punkers I spose, burt whatever, this isnt high school

So I had 2 important job interviews on thursday, well I wokle uyp and got ready, went outside to find my truck with a smashed out driver side window and windsheild. Now I cant prove it was him, but who do the fingers point to? I was furious, so I cancelled my interviews and called the local PD. What did he say? He wouldnt even come and look at my truck and said I was 'SOL' because I had no proof.

Well I went about my day, went to my girlfriends, etc.

I was sitting at my moms house when 2 cops came to my house telling me they have witnesses that I did this, and etc etc and I was pretty intimidated and scared as they were in my face TELLING me I did the crime. I hate confirtations but I told them I did it cause I was scared. They told me I went to ryans house and smashed out his windows earlier that day...after mine were out.

Now, the only reason I admitted is because these police were so intimidating I was in shock and did not know what to do.

Now here I am, with the police saying I am being charged with a felenoy, there going to take away my moms car becase that was what I was drving, and all this.

I dont know what to do, they say they have a witness.

Now this is where it gets tricky, the cops told me 'that the witness saw a green sunfire smash these windows with the person wearing khkaki pants and a blue shirt' thsi is what I was wearing.

Now a buddy of mine whos know about this kid threatening me and etc, emailed him asking why he did what he did, and the kid replied with a pretty mean email abnout me, saying that 'him and his witness aw a black escort and 2 people get out and smash a window' Now there is 2 different stories here, and I have proof of this email as well as some other emails ryan has sent me, showing the HATE he has for me.

I called a couple attorneys but everyone was too busy to help me at the time, thats when I found this site.

The police gave me no papers or anything, saying it will be mailed to me and I have to pay for the damagers?

And in ryans email to my friend, it says he has full glass coverage and has to pay nothing....so I dont understand.

Can someone please help me.

The only advice I can give is to get a video camera and stay up to see if they come back to do more and get them on tape. Print up the email and save it. Make sure you stay around people at all times for a while. That way you always have an aliby in case they mess up their own property again and also to be around you as a witness in case they come to bother you. Don't ever admit to something you didn't do to the police. I know they can intimidate you but that's what they are trying to do. They always get people to admit to things they didn't do that way. It's best to just calmly deny everything they say even if they are yelling at you. If they bring up charges on you and arrest you just keep denying everything and say you want a lawyer. They have to provide you with one then. If you get a bill for the window, don't pay it. Say you never admitted to anything and you didn't do it. They would have to prove you did in court then and you can show the judge the email. Keep trying different lawyers though. There must be one that can give you some advice even if you have to pay for that hour of time it would be worth it.

I'm not sure why you didn't just notify myspace that this person is harassing you and have them cancel his account and IP. As far as the rest goes, just because someone may have insurance coverage doesn't absolve you from being prosecuted for a criminal act. You trespassed on and destroyed property. Regardless of whether the victim ends up with insurance, your act is the act. Same as if you would hit him and he might have medical insurance. It's still assault.

I'd wait until you get "the papers" and deal with it then. Just hope that they aren't criminal in nature or that they never arrive. Good luck and let us know how things turn out.
