Motorcycle Deposit: nonrefundable?

I live in Alabama.

Recently I've been in the hunt for a very hard to find motorcycle.

Here are the facts:

1) My wife managed to find a dealer who has a number of Kawasaki Ninja 250r's on order(they do NOT have them in stock, nor do they have a firm date of delivery)
2) She paid a $250 deposit, putting me on the 'waiting list'
3) One week later, another motorcycle dealership informs me that they have this particular motorcycle in stock, and I decide to buy from him
4) The first dealership is now refusing to give me the $250 deposit back

This dealership is in Alabama as I am, and nothing has been signed by either party indicating that the deposit would be non-refundable. My wife can't remember the conversation she had with the guy, but she does remember that there was no separate conversation having to do with the 'non-refundability' of the deposit.

My question:

1) Does the dealership have a leg to stand on? If not:

2) What should be my next move after asking for the dealership politely to refund my money

Any help is appreciated!
