Misrepresented Timeshare sale/purchase

Good Morning,

I purchased a timeshare in Las Vegas, Nevada on the condition of a very clear set of requirements being met and which requirements were both accepted and agreed to by the agent. (At the time, lived in CA – now living in TX)

At the time, the agent admitted to being 'fairly new' in the business and as a result, we asked the Agent to check the various points with her Supervisor/Manager, especially the swop parameters – for which purpose she left our table, from time to time during the conversation, returning with positive confirmation each time.

As a result of the agent's promises and assurances, we agreed to purchase the timeshare on the following basis:

1) GRANDVIEW PURCHASE
It was understood and agreed by the agent that in purchasing this timeshare, I had no interest in The Grandview itself as a destination – only the ability to swop my week for other weeks and destinations, as shown below.

2) SWOPS AS AGREED
It was understood and agreed by the agent that in purchasing this timeshare, I would be able to annually exchange the week/accumulated weeks for 'Gold Crown', 'Red Time' timeshare, or any lower levels, in my clearly defined and stated annual times and destinations of –

a) Vail/Avon/Beaver Creek/Eagle, Colorado – particularly during major holidays
including Thanksgiving, and/or Easter and/or Halloween and/or Independence Day
and/or Labor Day etc – sometimes Christmas / New Year and/or
sometimes during non-major holiday periods.

b) Dublin and/or surrounds in the Rep of Ireland - usually during October/November
and occasionally during December or at other times.

c) Cape Town / near surrounds, South Africa – usually during the early December to
mid January period and occasionally at other times.

It was confirmed that all of these destinations have timeshare resorts and that we would be able to easily exchange our timeshare weeks at these destinations and at these times.

3) OTHER SWOPS
On a few occasions, we have tried to use the timeshare for family members in other timeshare destinations –with the same negative result – NOTHING EVER AVAILABLE.


4) UNIT RENTAL
Should I not wish to exchange my week in any particular year for any reason, I was assured that the Grandview would rent out my double-room week.

During discussions, I had constantly requested that if I purchased, I would want a timeshare week over Christmas and/or New Year but the agent insisted that:

a. If I bought 'Week 16 ' - I would have a 'superior' week as that was the week of the Nascar racing in Las Vegas and as the entire city was fully booked each year during that week – Grandview would rent out my double unit at a premium.
b. Rentals of my double unit would be at a high rate of return.

During the entire time of this process, there has only been ONE HALF RENTAL - when half of my double-unit was rented out at a nominal sum.

SUMMARY
To date, having met all payments on time for the timeshare, maintenance and RCI and
as a result of the complete and total misrepresentation in being falsely sold a timeshare –
I have not once been able to get any swop accommodation of any kind at any of my destinations at any time.

Instead, I am constantly (and infuriatingly) always asked to change my destinations to unrelated cities/states/countries - often up to thousands of miles away - or asked if I will rent - to see if they can get more commission money from me by selling me other peoples rentals??.

MY QUERIES

What recourse do I have toward:

a. Canceling this totally misrepresented sale and…

b. Getting repaid the excessive monies I have been forced to pay…for promised
usage services not rendered or available.
- Purchase and interest costs.
- Maintenance costs
- RCI costs
- loss of income and interest on capital expended.

The high expenses of this unusable purchase to date and the ongoing high monthly and annual costs for a purchase that gives us no value or use whatsoever - is causing us exponential distress and harm, particularly in this tough economy which has left me unemployed since last November.

I would very much appreciate your kind assistance in this matter.
