I would apreciate comments on the following:
I have been an F-1 student in California for 3 years. 2 months ago I got booked (1 day jail) although I didn't even see the inside of a cell- for using a fake train pass. A week ago I was in Court for misdemeanor with penalty of up-to-1-year and $1000 fine, but received only a $100 fine, no community service and the 1 day in jail that I already "paid" when I was booked.
My visa expires in 2 months, and my I-20 in 17 months. I will graduate in December and wish to apply for a 9-month to 1-year Optional Practical Training (OPT).
1. Should I leave the U.S. and renew my student visa in SoutrhAmerica? What could happen if I leave in 1 month, try to renew my visa and come back after 10 days?
2. Should I stay in the U.S?
3. Will I be elligible for an H1 visa after my OPT?
4. Will I be eligible for residency in the future since my brother will take his citizenship exam in the next few days?
