Would you mind explaining how the situation that I'm about to explain affects
my Adjustment of Status, by marriage, application.

I applied for a Green Card last year but I had a legal case that was not solved
and USCIS denied because they needed the Court Disposition on the case and
I could not get it within the time specified by them because the case took months
to be resolved by the court.

Finally, the case is over. I pleaded guilty to a violation, which is not a crime. The
sentence imposed was a PG240-20; Imprisonment=TS; order of protection=2Y.

I'd like to know if I reapply for the green card, will the PG240-20 charge (a violation) and
the order or protection mentioned above affect my application? I'm more concerned
about the 2-year order of protection.

The original application was going well, including the interview, until the unresolved
case popped up and the USCIS officer asked for the court disposition.

I'll appreciate an answer to this issue. I have no way of knowing and it could affect
my future in the US.

Thank you very much in advance for your kindness.

I disagree, my friend.

You were charged with DOMESTIC VIOLENCE, despite your protestations to the contrary.

The persecutor and your fine defense attorney got the charge pled to a lower level offense.

You're serving probation as a guest in this country.

I can't say what USCIS will do to or for you.

I suggest you direct your inquiries to USCIS:

https://egov.uscis.gov/cris/Dashboard/CaseStatus.do

http://www.uscis.gov/laws

YOU are FREE to hire yourself another fine attorney specializing in immigration law.

I can say that had you not chosen to THUMP, BUMP, BATTER, BEAT, and ABUSE your woman or man; you'd not be in this position today.

These are great times for illegal and legal aliens who wish to come to the USA.

Unfortunately, you may have THUMPED and ABUSED your chances to remain in the USA.

Frankly, there are dozens of countries for peaceful, productive, prosperous people to populate these days!

Pg 240-20

Thank you for your reply.

The charge was disorderly conduct and not domestic violence.

There was no fighting, bumping or beating of any sort.

Everybody in this world can have incidents or do something
wrong or make mistakes in their life, like this one, even though
you did not instigate or start them.

I'm trying to do something right if I am to stay in this country, such as
paying taxes.

My objective was to know, if my court disposition shows an order
of protection for two years, will it affect the decision of USCIS.

Can anyone help me out?

Yes, hire yourself a lawyer.
Yes, speak with the officials at USCIS.
Only a proper US government official can say if you stay or leave.
We are a small, privately owned legal site.
We have no authority or say over you or any other matter.
You need not explain further here.

Yes, we set up an appointment with USCIS to ask about my case.

My objective for posting here was to ask people with similar case,
experience about the case like mine and how they resolved their case
or got through it.

I understand that in all cases, situations are different and problems are
resolved in different ways, but feedback from others are like case studies
which give an opportunity to see how others have solved problems.

That is what the web board is for.

Yes, there are many countries available for peaceful, productive and prosperous
people. You can stay where ever you want but you are not happy unless your
heart is happy.

Thank you again for your suggestion.

No matter what trouble we wander into or create for ourselves, CONTRITION can help us get forgiveness and compassion.

The contrition you're showing will help you in your struggle.
Being sincere and apologizing is also required as you struggle for redemption and atonement.
Be aware of your tone as you speak to the court.
Whatever you do, don't minimize your good or bad acts.
Embrace them, own them, ADMIT your responsibility.
Don't repeat here what you said earlier. In court, that won't work.
The judge sees EVERYTHING, reads EVERYTHING, and won't be fooled by a plea bargain.
He sees the original charge, the pictures of the battered victim, etc..
If people went to jail for SHOVING AND PUSHING, no one would ride the subway.
If you can't tell the entire truth, don't say anything.
You have the RIGHT not to speak.
