Hey, I am from Kearney, Nebraska. I got an MIP when I was 18 for holding an unopened can of beer for a friend. I have already gone to court, pleaded guilty, taken a class, and spent 24 hours in jail..all of which were required by the court. My question is how long will this MIP stay on my record? I have heard several different things from it will be there forever, it will go off your record when you turn 21, and after 3 years it will expire. Can you tell me which, if any of these, are correct?

What your friends told you may all be true and not true. I'm not sure of the law in Nebraska but what was told to you is vague. When you say "off your record" that might mean that if you have another offense for MIP then the first isn't considered against you so that you can be charged as a repeat offender. It may not mean that the record is expunged automatically so that employers or others cannot find a record of your guilty plea. I would doubt that is the case.

What your friends might also mean are cases where the judge withholds a decision and basically gives you a probationary period which, if you complete, then the charges against you are dismissed. Thus you don't have a "record" of a conviction but in your case there is a judgment due to your guilty plea. Maybe you should ask your friends for more information and point you to specific laws which might support their statements.
