Tonight, at roughly 12:00 am, I was given a citation for open container after stepping outside at a friend's birthday party. The officer gave me a citation for only open container and not minor in possession even though I gave him my driver's license which clearly showed me to be underage. What I am most curious about is if I can be legally charge with MIP when I go to pay my fine even though the officer didn't write me a ticket for it.

Also, I was not given my license back, how is this going to affect how everything works out?

Any help that can be offered would be greatly appreciated as right now I am very scared as to what could happen to me. This is my first run in with the law and I have no idea as to what the worst that could happen to me is. I am also able to pay the fine, but should I pay it if they are able to charge me with MIP?

They aren't going to charge you when you go pay your fine. If you were to kick up a stink about the ticket someone may charge you. Go pay your fine, ask the clerk about your license. I don't know what state you are in but some states keep your license as sort of a "bond" to insure you appear for your ticket.

Yeah, I was sort of figuring that was how it was, but as I said, I have never had anything happen with the law so I wasn't entirely sure about whether or not they could tack on additional charges. Thanks for the help.
