If we are selling a 3d printed file of a WWII vehicle, in this case a Sherman Tank. And we got a email to cease sales because they claim they also have a file to print Sherman tanks that they created. If we both created the same thing how can someone else claim its theirs?

This was a Tank that was produced in large numbers during WWII. How can you claim you own copyrights to it? There are dozens of files that you can make/get to print and sell this.

I realize this is an odd question but one Im curious about. If any additional details are needed feel free to respond. Thank you

They can claim it because we have freedom of speech.

They are not claiming a copyright for the tank. They CAN claim rights to their design. If you made your own design independently, then you have nothing to worry about in the long run, but you will need to respond in some way.

They can "claim" anything they want. Whether they can make it stick is something else.

There's seems to be a plethora of 3D Sherman tanks online.

I haven't looked further into whether they are all from one vendor or not. You can do that if you like.

Bottom line: If you are deriving income from it and somebody is challenging you, a short but strong letter from a lawyer would not cost much and may put an end to the challenge.

Anybody in business selling anything needs to be prepared to pay a lawyer occasionally.
