Who has legal rights in Kansas for legal decisions for spouse. Mother or wife. Husband had stroke. No power of attorney or medical power of attorney
 
Per my reference in Ks. & most all states - the wife is 1st in line. You can always run it by a lawyer to verify.

Why does the mother think she has any rights here?

Betty is correct; the spouse is the legal next of kin.
 
Spouse, assuming they are LEGALLY married, not just cohabiting.
 
"Wife" generally indicates a marriage.

Yes, I agree, when I was growing up, wife meant married.

A man and a woman were the only things that could marry.

Man husband, woman wife, ugh.

Today, a wife can result between two women, one man man one woman, or two men.

Or, several people can create a marriage, and multiple wives can be named, also multiple husbands.

Things are changing.

Finally, people just say they're married, hence the bit about LEGAL marriage.

I try to be cognizant of the way the world works these days.
 
In this case, "I believe" we have a legal marriage & between man & woman (husband & wife). If not, OP can come back & say. My answer still stands based on info received/info we know - wife, not Mother.
 
I hate getting the character limit - I never know what to type but I think of something to add. :)
