I closed on a home on November 30, 2007. Now I have been named as a defendant in a case where the builder (Davis Homes in Indiana) failed to pay the vendor who supplied the lumber for the house. This is in addition to other issues I have had with this home, and I am no receiving any contact from the builder. I am going to file a counterclaim to dispose of my name from the lawsuit. Can I file another suit for damages against the builder?
